Resumen
La mediac ión en Argent ina ha resultado
i ncor porada –mayor i t a r i ament e – a l a s
inst ituciones, sea porque directamente se
regentea el servicio, se lo supervisa o controla por
los poderes institucionales o porque se reconocen
sus efectos en forma institucional. Surge así
una forma especial de mediación: la mediación
institucional.
Este tipo de mediación impone el análisis de
relaciones sociales que influyen claramente en
las partes y en los mediadores y que podrían
determinar la presencia de acciones específicas
encuadradas dentro del poder del mediador
y otras que surgen en virtud de la existencia
del poder contextual transferido al mediador.
En idéntico sentido, el contexto institucional,
vinculado a la prejudicialidad del proceso, puede
conducir a formas no conscientes de “presión” por
parte del mediador y a la producción de efectos
nacidos del poder y la cultura respecto del sistema
social denominado mediación institucional.

Summary
The mediation in Argentina has been built
–mostly– by the institutions, either because
the service is directly led by the institution,
supervise or control it by institutional powers
or because their effects are recognized in
institutional form. Thus arises a special form
of mediation: institutional mediation.
This type of mediation requires the analysis of
social relations that clearly influence the parties
and the mediators and could determine the
presence of specific actions framed within the
power of themediator and other arising under the
existence of the power of context transferred to
the mediator. In the same sense, the institutional
context, linked to the pre judicialityss, can lead to
unconscious forms of “pressure” by the mediator
and the production of effects regarding the social
system called institutional mediation born of
power and culture.
